Achieving Safety Through VAWA Self-Petition
We are excited to share another success story – VAWA approval for our client! This milestone highlights how individuals facing abuse can find hope and relief through immigration laws designed to protect their rights and safety.
In this case, our client endured severe abuse from their spouse, who threatened to call ICE and have them deported, destroyed their belongings, and refused to help with their Green Card application. Abuse can take many forms, including emotional, psychological, or financial harm, not just physical violence. In this case, our client did not experience direct physical violence and never made a police report.
The VAWA process involves filing Form I-360 and providing evidence of the abuse, a qualifying relationship, and good moral character. Once the I-360 is approved, applicants may be eligible to apply for a Green Card. Most clients are eligible to file their adjustment of status applications concurrently with their VAWA application. This allows for clients to receive work authorization within 7 to 9 months of applying, a social security number, and travel authorization.
USCIS has now issued our client a work permit based on their VAWA approval! The next step is to wait for their Green Card approval. We look forward to shepherding our client through these next steps.
