Another Family Reunited – Green Card Approved!
We recently helped our client secure a Green Card for their mother, allowing her to live permanently in the United States. This case highlights how U.S. citizens can petition for their parents and the importance of properly preparing an immigration application—and standing up to the government when necessary.
A U.S. citizen can sponsor a parent for a Green Card by filing Form I-130 (Petition for Alien Relative) and providing proof of the relationship, such as a birth certificate. In this case, we ensured all required documents were submitted correctly and responded promptly to any USCIS requests.
This case was unique in that USCIS issued several Requests for Evidence (RFEs), which, in our experience, has become more common in cases where a U.S. citizen is sponsoring a parent through the adjustment of status process. Here, the government took issue with the name on the applicant’s birth certificate and why it differed from the applicant’s other documents, such as school certificates and children’s birth certificates. In many countries, a person’s legal name may differ from the name on their birth certificate.
Even after our firm responded to the RFE, the government scheduled an interview specifically to discuss the issues raised. We represented our client during this interview and reiterated that all the documents provided complied with the requirements of the Immigration and Nationality Act. We also pointed out that the government was holding the applicant to a higher standard than required by law. To address the officer’s concerns, we suggested speaking with a supervisor for further clarification.
The application was approved, and our client’s mother received her Green Card.
