Executive Order Restricts Federal Benefits for Undocumented Immigrants

On February 19, 2025, President Trump signed an Executive Order (EO) directing federal agencies to review all programs that provide benefits to undocumented immigrants and take steps to limit access where legally permitted. The EO requires agencies to identify federally funded programs that allow undocumented individuals to receive cash or non-cash benefits and take actions to bring those programs in line with federal law. Additionally, it instructs agencies to ensure that federal payments to states and local governments do not support undocumented immigrants, including assistance provided by sanctuary cities. The order also calls for stronger eligibility verification for federal benefits.

Many federal programs already restrict benefits to U.S. citizens or lawful immigrants, so the immediate effects of this order may be limited. However, it could lead to stricter enforcement measures, increased screening for benefit eligibility, and potential funding cuts to state and local programs that provide assistance to undocumented individuals. Areas that may be affected include emergency medical services, housing programs, food assistance, and education funding that relies on federal support. The EO may also impact nonprofit organizations and community programs that receive federal grants.

For states and local governments, compliance with this EO could mean adjusting policies or facing financial penalties. Cities that provide aid to undocumented immigrants may lose federal funding, particularly those with sanctuary policies. Some local agencies may need to implement additional eligibility verification procedures, which could delay access to certain services for all applicants. The scope of enforcement will depend on how federal agencies interpret and implement the EO.

For individuals, this order may increase scrutiny in benefit applications, making it more difficult to access certain services. Those who are undocumented or have mixed-status families should stay informed about potential changes to eligibility requirements.  If you would like to explore options on how to obtain lawful status in the U.S., please contact Agarwal Law Group at 703-348-1663 for guidance.
