Can Men Qualify for VAWA?

 

 

It’s a common misconception that only women qualify for protection under the Violence Against Women Act (VAWA). However, VAWA is gender-neutral and extends its safeguards to individuals of all genders who have suffered abuse at the hands of a U.S. citizen or lawful permanent resident spouse or parent.  Some of our clients also include individuals who have suffered abuse from a U.S. citizen child 21 or over.  

This misunderstanding can dissuade eligible victims of abuse from seeking assistance and receiving immigration benefits including permission to remain in the U.S., receive work authorization, a green card, and citizenship.  VAWA’s provisions are inclusive, ensuring that all VAWA applicants have access to the necessary legal protections and resources.

Under VAWA, individuals can access various benefits, regardless of gender. These benefits include the ability to self-petition for lawful permanent residency, independent of the abuser’s consent or awareness. Please note that the abuser is not contacted and is not a part of the VAWA application process.  This provision is particularly crucial for applicants who may fear retaliation or further abuse if their abuser is aware of their pursuit of legal status. Additionally, VAWA offers protection against deportation for survivors who are in the process of seeking relief under the act. This safeguard provides VAWA applicants with a sense of security and stability as they navigate their immigration status.

Furthermore, VAWA gives individuals the opportunity to receive employment authorization, enabling them to support themselves and their families independently.
