Court Injunction Pauses Approval of Parole in Place Applications

The Parole in Place program, which allows certain noncitizen spouses and stepchildren of U.S. citizens to request temporary lawful presence and receive a green card without first leaving the country, is experiencing major disruptions. Although applications can still be filed, no approvals will be issued during this period. This could result in delays and uncertainty for those relying on the program.

 

A recent court injunction has placed significant restrictions on the Parole in Place (PIP) program. While U.S. Citizenship and Immigration Services (USCIS) can still accept Form I-131F applications, it cannot approve them at this time. The injunction is in effect for an initial 14 days while legal arguments are reviewed, with the possibility of an extension. There is also the potential that the government may be prevented from both accepting new applications and approving existing ones, depending on how the situation develops.
