Employment-Based Visa Number Unavailability for FY2024

 

As of September 9, 2024, the U.S. Department of State (DOS) confirmed that all visa numbers in the employment-based (EB) categories for fiscal year 2024 (FY2024) have been used. This includes EB-1, EB-2, EB-3, EW (other workers), EB-4, and EB-5 (unreserved) visas. No more immigrant visas or green cards will be issued in these categories until the new fiscal year starts on October 1, 2024.

 

This outcome was expected. In the September Visa Bulletin Briefing, DOS warned that, due to high demand, certain visa categories could become “unavailable” before the end of the fiscal year. When numbers are exhausted, USCIS will still accept adjustment of status applications based on the September 2024 Visa Bulletin, but no new cases will be approved until FY2025.

 

Visa number unavailability started with EB-1 on August 27, 2024, followed by EB-3 and EW on August 16, 2024, EB-4 on August 29, 2024, and EB-2 on September 9, 2024. DOS typically does not release a new Visa Bulletin when all visa numbers for a category are used.

The annual visa limits will reset on October 1, 2024, with the start of FY2025. At that time, embassies, consulates, and USCIS will resume issuing immigrant visas and approving green card applications for these categories.
