New Parole in Place Program: Applications Accepted Starting August 19, 2024

Dear Clients and Friends,

We are excited to inform you about an important new development in immigration law. Beginning August 19, 2024, the government will start accepting applications for the newly announced Parole in Place (PIP) program. This program offers significant relief for undocumented spouses of U.S. citizens, who entered the U.S. illegally, allowing them to remain in the United States while applying for lawful permanent residency. This opportunity is incredible because current immigration regulations require these individuals to leave the U.S. to process their green card and then re-enter upon visa approval.  Many individuals were reluctant to seek immigration benefits for fear of being separated, perhaps permanently, from their children and family in the U.S.

Below, we cover the eligibility requirements for the PIP program and the documents you can start gathering in order to be ready on August 19, 2024.

Eligibility Requirements

The new Parole in Place program is specifically designed for undocumented spouses of U.S. citizens who meet the following criteria:

  1. You must have entered the U.S. without inspection (i.e., without a visa or other form of legal admission) and currently have no lawful status.
  2. You must be legally married to a U.S. citizen as of June 17, 2024.
  3. You must have lived continuously in the U.S. for at least 10 years as of June 17, 2024.
  4. You must not have any prior deportations, certain criminal history, or pose a threat to national security or public safety.

This program does not extend to spouses of permanent residents, parents of U.S. citizens, or those who entered the country legally with a visa or other documentation.

Documents to Start Gathering Now

To prepare for the application process, it’s important to start gathering the necessary documents early. Here’s what you should begin collecting:

  1. Proof of Identity:

   – Valid or expired government-issued identification (e.g., passport, driver’s license)

   – Birth certificate with a photo ID

  1. Proof of Marriage:

   – Marriage certificate showing you were legally married to a U.S. citizen as of June 17, 2024

  1. Proof of Continuous Presence since June 17, 2014:

   – Documents such as rent receipts, school records, medical records, financial records, and tax returns that prove continuous residence in the U.S. for at least 10 years

  1. Proof of Spouse’s U.S. Citizenship:

   – Your spouse’s U.S. passport, birth certificate, or Certificate of Naturalization

  1. Criminal and Immigration History:

   – Certified criminal records (if applicable)

   – Any immigration records that could impact your eligibility

Starting to gather these documents now will help ensure your application is ready for submission as soon as the program begins accepting applications.

Significance of the Program

The Parole in Place program represents a crucial opportunity for eligible undocumented spouses of U.S. citizens. It allows them to apply for lawful permanent residency without having to leave the United States, avoiding the risks associated with consular processing abroad. If granted parole, applicants will receive temporary protection from deportation and be eligible for a work permit. Most significantly, this program offers a potential pathway to a green card while remaining in the U.S., helping families stay together while securing their future in the U.S.
