Top Tips to Prepare for Your Marriage-Based Green Card Interview
A marriage-based green card interview can be straightforward or challenging, depending on how well the couple knows each other and how prepared they are to prove the legitimacy of their relationship. The goal of the interview is to confirm that the marriage is genuine and not for immigration purposes.
USCIS and the interviewing officer are interested primarily in establishing that the couple has a real bona fide relationship and that the marriage was not entered into with the purpose of evading immigration laws. The officer will ask questions regarding, but not limited to, the following:
- How did the couple meet
- When did they become an official couple
- When did they get engaged (and details surrounding the engagement)
- Details regarding the wedding
- Current marriage relationship (living arrangement, children, home life dynamic)
- Joint assets, bank accounts, insurance, leases, property
- Personal details regarding the spouse (family members, studies, health issues, previous marriages, previous marriage termination, children from other relationships)
While officers can ask detailed questions, the couple has rights during the interview. They should not face overly intrusive or inappropriate questions. The couple has the right to request to speak with a supervisor in the event they feel questions are overly intrusive or inappropriate.
In addition to confirming the marriage, the officer will check for issues that could affect the foreign spouse’s eligibility for permanent residency, such as criminal records or past immigration violations. Consulting an immigration attorney before the interview can help identify and resolve any issues, making the process smoother. At Agarwal Law Group, we provide attorney representation for green card interviews conducted in the U.S.
Being well-prepared and honest is key to a successful interview. Couples who can clearly share their relationship story and provide evidence of their genuine connection are more likely to succeed.
